Introduction

The Domestic Abuse Act 2020 has now had time to bed in, so what better time to get up-to-date with the law and procedure in relation to domestic abuse?

Prosecuting or defending in such cases always presents a unique challenge - will the witnesses turn up, what will they say, what if they don’t say what we expect them to? And do we need any witnesses at all?

In addition to the evidential issues, this live broadcast session will also look at ancillary issues such as the new definition of ‘domestic abuse’, witness summonses, sentencing guidelines, restraining orders on acquittal and the new domestic abuse protection notices and orders being piloted in certain courts.

What You Will Learn

This live and interactive session will cover the following:

  • Hearsay evidence - admissibility of the 999 call and res gestae generally
  • Previous inconsistent statements - how can I prove them
  • The hostile witness!
  • Restraining orders on acquittal - Court of Appeal guidance
  • Sentencing guidelines in relation to domestic abuse - what do I need to be aware of?
  • Digital disclosure - recent guidance from the Court of Appeal on what is covered by the Criminal Procedure & Investigations Act
  • The not so new Domestic Abuse Act 2020
  • Domestic abuse protection notices and orders
  • Breach of the new order - what’s it worth?
  • Notification requirements if subject to the new order & offences in relation to not notifying or providing the wrong information - all you need to know
