Introduction
The legal framework relating to the various different types of leave available to employees when having or adopting children is vast and has expanded over recent years.
The introduction of Shared Parental Leave has so far had low take up, but this could change following a government report in 2023 which suggests there needs to be improved awareness and possible improvements to this right. The rules relating to eligibility and implementation of this are more complicated and can be confusing for both employers and employees.
Since April 2024 the redundancy protection period for employees on maternity leave has been significantly extended and needs to be carefully considered by employers.
