Introduction

We know from experience that many employers fail to appreciate the elements that define harassment which result in claims against them. Investigators need to have a clear understanding of what constitutes harassment under discrimination legislation. This is to ensure that decision makers at grievance and disciplinary hearings make the correct findings so that they do not have claims against them from wrongly accused perpetrators or are vicariously liable for their worker’s harassment.
