Introduction

Advisers need to provide advice to the lay attorney, as agent of the donor for them to undertake their role and ensure they act in the donor's best interests.

Getting it wrong can result in fallings out within the family and removal by the Court of Protection.

It is not sufficient that a donor simply chooses an attorney they trust, the attorney needs to be supported to navigate this complex area.

This new virtual classroom seminar is suitable for fee earners who advise and draft LPAs.

What You Will Learn

This live and interactive course will cover the following:

  • Identifying who is your client in different situations
  • When to provide copies of LPAs to the attorney
  • Deprivation of liberty and mental health detention and the welfare attorney's role
  • Understanding capacity as a welfare attorney
  • Preparing the welfare attorney for end-of-life decision making
  • Gifts, maintenance, and tax planning as a financial attorney
  • Selling a property owned in joint names as a financial attorney
  • Attorney buying the donor's home and managing fiduciary duties

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
