Introduction

Lasting powers of attorney (‘LPAs’) have been around for some years but continue to cause problems for practitioners.

Understanding how attorneys make decisions can assist professionals in drafting powers, helping them to avoid and resolve problems.

This new virtual classroom seminar will examine the problems and pitfalls of LPAs and is aimed at fee earners who advise on and draft lasting powers of attorney.

What You Will Learn

This live and interactive session will cover the following:

  • What if jointly appointed attorneys can't or won't agree on a decision?
  • What if joint and severally appointed attorneys can't or won't agree on a decision?
  • Can the attorney access the joint account?
  • What if the donor's LPA does not include power to invest via a discretionary management regime?
  • When can an attorney see the donor's will?
  • Can a property and affairs attorney ever access health and care records?
  • How and when should a welfare attorney prove their authority and to whom?
  • What happens if the welfare attorney discovers the donor has made an advance decision to refuse treatment?

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
