Introduction
Whilst the internal sanctioning powers of the SRA were increased in summer 2022, referrals to the SDT are generally reserved for the most serious allegations. There are still a substantial number of cases referred to the SDT and the SRA are currently consulting on proposals to refer all cases of convictions for drink driving to the SDT where a warning or rebuke is not appropriate.
Understanding how referrals to the SDT work and how best to prepare for proceedings is essential. The process can be complex and the SDT has specific procedure rules governing how cases should progress and how evidence is introduced.
It is not uncommon for investigations by the SRA to take several years but for tight timescales to be imposed by the SDT requiring responses and documents to be prepared by Respondents in proceedings. It is essential that consideration is given to preparing cases before they reach the Tribunal.
