Introduction

This new full day course is designed to ensure that delegates are confident in advising older and vulnerable clients.

It is suitable for newly qualified lawyers, trainees, and paralegals, and practitioners in any field wishing to change specialisms as it assumes no knowledge at the outset. It is also suitable for practitioners who wish to build on existing knowledge.

What You Will Learn

  • The framework of the Mental Capacity Act 2005, its approach to the assessment of a person’s mental capacity and making decisions in a person's best interests
  • How to form an opinion as to a person’s capacity to make a will
  • How to draft Lasting Powers of Attorney, including the new digital powers
  • How to apply for an appointment of a financial deputy
  • How to advise clients about gifts to avoid care fees and the deliberate deprivation rule
  • When the NHS and Local Authority is responsible for meeting health and care needs, including charging for care
